Rules and Regulations

Eligibility

Yay for $20k Contest (the “Contest”) is open to entrants who are qualified mortgage customers of First National Financial LP (the “Contest Organizer”), and the entrant’s mortgage must not be in default of the terms and conditions of such mortgage, at the point during which the entrant is selected as a potential winner (see below for details regarding the draw date). Entrants require a My Mortgage User ID and password to enter the Contest. If you have not set up your My Mortgage account, you can register online at https://mymortgage.firstnational.ca.

All entrants must be legal residents of Canada and who are over the age of majority in their jurisdiction of residence at the time of entry. NO PURCHASE NECESSARY TO ENTER OR WIN.

Employees, directors and officers of the Contest Organizer and its representatives, agents, advertising or promotional agencies, and anyone else involved in the development or execution of this Contest (collectively, the “Contest Parties”) and all members of any such director’s, officer’s, employee’s, representative’s, and agent’s household or immediate family (regardless of where they live) are not eligible to enter the Contest. In these Official Rules, “immediate family” means spouse, mother, father, brothers, sisters, sons, daughters and each of their spouses. Entrant’s mortgage with the Contest Organizer must be a residential mortgage to qualify (as determined by the Contest Organizer in its sole and absolute discretion on the basis of its records). Only entries received during the Contest Period will be eligible.


Accept Official Rules

Participation constitutes each entrant's full and unconditional agreement to be legally bound by these Official Rules (the “Rules”). The decisions of the Contest Organizer with regards to all matters of this Contest are final and binding. Winning the prize is contingent upon fulfilling all requirements of these Rules.  

Contest Period

The Contest begins at 12:00am ET on October 1, 2024 and closes December 15, 2024 at 11:59PM ET (“Contest Period”). 

How to Enter

Participants can enter the Contest in one of two ways, by signing up for electronic annual mortgage statements, (“e-statements”), or if they have signed up for e-statements prior to the Contest Period, by submitting an essay, respectively as follows:

  1. Enter by Signing Up for e-statements.  To enter by signing up for e-statements, login to My Mortgage and follow the on-screen instructions to sign up to receive e-statements. Once you have selected that you wish to receive e-statements you will receive one (1) entry into the Contest.  
  2. Enter by Essay/Testimonial. If you have signed up for e-statements prior to the Contest Period, during the Contest Period, you may enter the Contest and receive one (1) entry by submitting your response on My Mortgage (i.e. via the Contest page) to the following question: What is it about First National’s service that makes a real difference for you? (maximum 150 words)   

Entry Limit

Entries through either method of entry are “Entries” and individually, an “Entry”. There is a limit of one (1) Entry per mortgage during the Contest Period (regardless of the method of entry). For greater certainty and the avoidance of any doubt, you can only use one (1) email address linked to a My Mortgage account to enter the Contest. If it is discovered by the Contest Organizer (using any evidence or other information made available to or otherwise discovered by the Contest Organizer) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Contest Organizer. Your Entry may be rejected if (in the sole and absolute discretion of the Contest Organizer) it is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period. The Contest Organizer is not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void). 

Verification

All Entries are subject to verification at any time and for any reason. The Contest Organizer reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Organizer – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information submitted (or purportedly submitted) for the purposes of this Contest; and/or (iii) for any other reason the Contest Organizer deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Contest Organizer within the timeline specified by the Contest Organizer may result in disqualification in the sole and absolute discretion of the Contest Organizer. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

Prize and Winner Selection

There is one (1) prize (the “Prize”) available to be won. The Prize consists of a twenty thousand dollars ($20,000.00 CAD) mortgage pre-payment paid by the Contest Organizer (not including property tax, life insurance or home warranty payments). If the potential winner’s mortgage balance is less than $20,000.00, any surplus remaining (i.e. any difference between the $20,000 mortgage pre-payment and the potential winner’s mortgage balance) will not be paid to the potential winner, in cash or otherwise. The Prize will be paid in the month immediately following the month in which it is awarded in accordance with these Rules. The pre-payment will not reduce the privilege allotment indicated in the entrant’s mortgage documents. The Prize winner will still be required to make their regular monthly mortgage payment(s) in accordance with their mortgage documents. The Prize is not transferable and must be accepted as awarded and shall not be exchanged for an amount of money. Any federal, or provincial and/or local taxes/duties are the sole responsibility of the winner. Should the winner refuse to accept his/her Prize, the Contest Organizer, its member financial institutions, their affiliated companies and advertising agencies are released from any obligation related to the Prize.

Draw Date

On January 6, 2025 at 10:00 a.m. ET at the Contest Organizer’s corporate head office, 16 York Street, Suite 1900, one (1) eligible Entry will be selected by random draw as the potential Prize winner from all eligible Entries received during the Contest Period. 

Odds

Chances of winning are dependent upon the total number of eligible Entries received within the Contest Period.

Potential Winner

The potential winner is not a winner of the Prize unless and until the potential winner’s eligibility and the potential winning Entry has been verified and the potential winner has been notified that verification is complete. The Contest Organizer will not accept screen shots, affidavits or other evidence of winning in lieu of its validation process. The potential Prize winner will be notified by telephone or e-mail. In order to be declared a winner, the potential Prize winner must first correctly answer, unaided, a time-limited, arithmetical, skill-testing question to be administered by mail, email, or by telephone at a pre-arranged, mutually convenient time, and then sign and return the Contest Organizer’s form of standard declaration and release form (the “Release Form”). If the mortgage selected is a joint mortgage, the mortgagee designated as the entrant on the on-line Entry form must answer the skill-testing question, but all mortgagees must sign the Release Form. If the potential Prize winner is not able to correctly answer the skill-testing question or fails to complete, sign and return any of the aforementioned documents within five (5) business days after notification, such potential winner will be disqualified (and will forfeit all rights to the Prize) another eligible entrant may be randomly selected at the sole discretion of the Contest Organizer and the process outlined above will apply to such newly selected entrant.  

General 

For Quebec Residents Only: Any litigation respecting the conduct or administration of this publicity Contest may be submitted to the Régie des alcools, des courses et des Jeux for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

Subject to applicable law and to the approval of the Régie des alcools, des courses et des jeux, (“Régie”), Contest Organizer reserves the right to cancel, terminate, modify these Rules or administration of or suspend this Contest in whole or in part without prior notice with no obligation or liability, including if for any reason the Contest is not capable of running as planned, whether due to technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Contest or other causes beyond the control of the Contest Organizer. In such event, the winner may be selected by randomly drawing from among all valid Entries received up to the time of cancellation, termination or suspension. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

The Contest Organizer reserves the right, subject to the approval of the Régie, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Organizer, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the French Rules, website, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

Personal Data

All personal information submitted in relation to the Contest will be handled in accordance with Canadian privacy laws and the privacy policy of the Contest Organizer. Your personal information will only be used in connection with the Contest, the Contest Organizer or your mortgage. If you are selected as a winner, you consent and agree that the Contest Organizer may disclose to your mortgage broker and the Régie, if applicable, that you have won this Contest. Unless you otherwise agree, your personal information will not be used for any other purpose and will not be shared with anyone else.

Publicity

Except where prohibited, participation in this Contest constitutes each entrant’s consent to the use of his/her Entry, name, likeness, voice, opinion, essay/testimonial response (if provided) and biographical information for publicity, advertising, trade or promotional purposes in perpetuity, worldwide and in any media or manner, now known or hereafter devised, without payment, consideration, notice or approval.

Conditions of Participation

The Contest Organizer reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process or violates these Official Rules. The Contest Organizer reserves the right to, subject to the approval of the Régie and without further prior notice and at any time, remove participants or terminate this Contest, in whole or in part, or modify the Contest in any way, should any factor interfere with its proper conduct or impair the administration, security, integrity and fairness of play (as intended) of the Contest. All Entries become the property of the Contest Organizer and will not be returned. A person who attempts to undermine the legitimate operation of this promotion or to alter or damage a website may be subject to civil and/or criminal penalties and fines; and the Contest Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law. The decisions of the Contest Organizer with regards to all matters of this Contest are final and binding.

Limitations of Liability

By entering the Contest, entrants agree to release and indemnify and hold harmless the Contest Organizer, any of its advertising, promotional, publicity, production and judging agencies and its directors, officers, employees and agents from any claim, loss, expense (including legal fees) or other liability, including liability for personal injury, arising from participation in the Contest or the awarding, acceptance, use or misuse of the Prize.

By participating, entrants agree that the Contest Organizer is not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Contest; (ii) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (iii) digital or electronic disruptions, e.g., viruses or other security breaches; (iv) unauthorized human intervention, e.g., hacking; (v) technical or human error which may occur in connection with any aspect of the Contest; (vi) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Contest, or receipt or use of the Prize; and (vii) lost, incomplete, illegible or garbled Entries, mail or transmissions, interrupted or unavailable network, server or other connections, miscommunications, computer virus, bugs, worms, tampering, unauthorized intervention, fraud, failed computer hardware or software or telephone transmissions or other errors or problems of any kind whether mechanical, human or electronic.
